What States Have Enacted Industrial Hemp Policies

Hemp has been a controversial topic for decades. One of the biggest questions surrounding the plant is – it doesn’t get anyone high, so why was it ever made illegal? When did Hemp Become Illegal?

When Harry Anslinger became the head of the Federal Bureau of Narcotics and Dangerous Drugs, he bundled hemp and marijuana into the same classification – dangerous. In 1937, when marijuana prohibition began, hemp became illegal too. Hemp contains a minimal amount of THC, in most cases less than 1-percent. It’s impossible for you to get “high” from using hemp – impossible. Much of the country couldn’t understand how a plant with so many applications was dangerous.

The fact of the matter is – yellow journalism and blatant lies got in the way. Anslinger frightened the world with untruths and bullied much of the world into thinking that hemp and marijuana were dangerous. The thing is, Anslinger didn’t research enough to realize that yes, these two plants are in the same plant species, but are not, in fact, the same.

Since the distinction between the two wasn’t made, hemp was just rolled into the ban along with marijuana.

Dr. James Woodward did try to stop the 1937 Prohibitive Marihuana Tax Law, outlawing hemp specifically, from being passed. He was a physician and attorney. He testified on behalf of the American Medical Association (AMA), but his testimony went a bit awry. Rather than establishing the differences between them, he classified them as the same.

The public was purposely left in the dark regarding the differences between the two plants. The AMA, at the time, did recognize marijuana as medicine and it allowed it to be an ingredient in medicines for a long time.

Congress had it all wrong – they said that hemp was a violent/dangerous drug. Hemp threatened some big industries like plastics, paper and oil – so it had to be shut down so that these industry dynasties in cohorts with Anslinger could maintain their power and large bank accounts.

2014 Farm Bill

The Obama administration signed the 2014 Farm Bill into law. This includes a provision to allow the cultivation and processing of industrial hemp for research purposes. Institutions of higher education and state departments of agriculture can obtain proper license to cultivate and process industrial hemp. The cultivation sites must be registered with and approved by all state departments of agriculture.

Each state is permitted to adopt its own regulatory framework for industrial hemp cultivation. The Farm Bill requires that all industrial hemp test at 0.3-percent THC or lower.

The purpose of this 5-year pilot program is to study the agricultural benefits of the plant and research regarding other benefits such as economic stabilization, creating sustainable eco-friendly products and, of course, medical research.
